Property Rights, Indigenous People and the Developing World

This work offers an analysis of the Western formal system of private property and its moral justification and explains the relevance of the institution to particular current issues that face aboriginal peoples and the developing world. The subjects under study include broadly: aboriginal land claims; third world development; intellectual property rights and the relatively recent TRIPs agreement (Trade related Aspects of Intellectual Property Rights). Within these broad areas we highlight the following concerns: the maintenance of cultural integrity; group autonomy; economic benefit; access to health care; biodiversity; biopiracy and even the independence of the recently emerged third world nation states. Despite certain apparent advantages from embracing the Western institution of private ownership, the text explains that the Western institution of private property is undergoing a fundamental redefinition through the expansion.

Disjunctures

Disjunctures demonstrates the transformative potential of Indigenous political traditions in settler states that seek reconciliation. Though there exist irreconcilable differences between Indigenous and dominant Euro-modern political structures and identities, Yann Allard-Tremblay argues that these disjunctures highlight a way forward. In contrast to Euro-modern politics, Indigenous ways of thinking and acting politically emphasize harmony, not just among humans but within the broader ecological context. Reconciliation thus requires a deep transformation of political theory and conduct to recenter decolonial Indigenous political traditions.

The Dead of the Irish Revolution

The first comprehensive account to record and analyze all deaths arising from the Irish revolution between 1916 and 1921 This account covers the turbulent period from the 1916 Rising to the Anglo-Irish Treaty of December 1921—a period which saw the achievement of independence for most of nationalist Ireland and the establishment of Northern Ireland as a self-governing province of the United Kingdom. Separatists fought for independence against government forces and, in North East Ulster, armed loyalists. Civilians suffered violence from all combatants, sometimes as collateral damage, often as targets. Eunan O’Halpin and Daithí Ó Corráin catalogue and analyze the deaths of all men, women, and children who died during the revolutionary years—505 in 1916; 2,344 between 1917 and 1921. This study provides a unique and comprehensive picture of everyone who died: in what manner, by whose hands, and why. Through their stories we obtain original insight into the Irish revolution itself.

Consent has long been used to establish the legitimacy of society. But when one asks - who consented? how? to what type of community? - consent becomes very elusive, more myth than reality. In Between Consenting Peoples, leading scholars in legal and political theory examine the different ways in which consent has been used to justify political communities and the authority of law, especially in indigenous-nonindigenous relations. They explore the kind of consent - the kind of attachment - that might ground political community and establish a fair relationship between indigenous and nonindigenous peoples.
