Codification in East Asia
This book looks at codification from a broad, international perspective, discussing general themes as well as various legal fields. Since codification is a subject of intense current interest in East Asia, this second volume on codification is dedicated to the sub-theme of codification and legal transplant in this area, focusing on China, Japan, Korea and Taiwan. It includes two papers that discuss development of codification in East Asia and Korea in particular. It is also comprised of two reports that draw comparative lessons from Japan, India and Indonesia. In addition, this volume consists of four general reports and 19 national reports that guide readers through the knowledge of codification of commercial law, administrative law, civil law and private international law in East Asia. This book is developed from papers presented at the 2012 Thematic Conference of the International Academy of Comparative Law.
Compulsory Insurance and Compensation for Bunker Oil Pollution Damage
Oil tankers are not the only vessels that have caused oil pollution at sea. Numerous spills in the past have been of heavy fuel oil from non-tankers. However, the international liability and compensation regime covered only oil pollution damage caused by oil tankers. There was thus a need to bring the law on marine oil pollution responsive to oil pollution damage caused by non-tankers. In March 2001, the International Convention on Civil Liability for Bunker Oil Pollution Damage was adopted following a diplomatic conference at the International Maritime Organization. Though this convention has not yet come into force, its various aspects should already be considered as they will surely affect the maritime industry as a whole and the non-tanker sector, in particular. This book provides a timely and comprehensive study on the concept of compulsory insurance, its main purpose of ensuring compensation and its interrelations with other features such as the rule of strict liability and the limitation of liability under the convention.

English Abstract: This is the text of my speech in honour of Jürgen Basedow on the occasion of his farewell from active service at the Max Planck Institute. These remarks serve at the same time as the introduction to a symposium organized by Basedow's former students that was titled “Mehr Freiheit wagen” (“Risking more freedom”). The speech traces an arc from Roman law to Jürgen Basedow's manifold fields of professional activity; alongside the breadth of his interests, my remarks highlight his steadfast cosmopolitan conviction and his sense of the links between legal scholarship, legal practice and legal policy.
