Several commentators have noted the tendency of the U.S. Supreme Court to produce a higher number of non-consensual opinions than other courts. Best (political science, Buena Vista U.) applies an institutional perspective to examine the impact of growing numbers of law clerks and other support personnel on the issuance of non- consensual opinions. He suggests that the law clerks serve to isolate the justices from each other, therefore leading to a rise in dissenting and concurring opinions. Multiple regression equations and other quantitative methods are applied to the history of the court in order to test the thesis and fail to find substantive correlation, but Best argues the evidence does show that changes in the number of opinion can be related to caseload and changes in the occupant of the chief justice's seat.
