The role of civil society organisations in Brussels is debated. Some view them as representatives of their members and thus as legitimising agents for policy-making in the European Union. Others see them as being elitist and out of touch with their membership bases, therefore ill-suited to promote democracy at the EU level. Taking civil society organisations in the EU’s external relations as an example, Meike Rodekamp submits these controversial views to a reality check. Interviews with representatives of civil society organisations in Brussels and their member organisations in the EU show that the Brussels offices have not lost contact with their members. However, member organisations differ substantially in their participation in internal decision-making processes, which raises doubts about the legitimacy gains through civil society participation in EU policy-making.

The European Union is widely regarded as premised on an imbalance between market-making and market-correcting provisions, potentially weakening national welfare systems and the political legitimacy of the European project. However, a stronger role for the EU in social policy faces considerable difficulties. The Open Method of Coordination (OMC) represents a new governance approach to European social policy and was adopted in the late 1990s. It seeks to provide a 'middle-way' solution to the dilemma of European social policy in which the EU adopts a stronger role in coordinating member states' social policies while member states formally retain their authority in social policy. New Governance in European Social Policy explores the effectiveness and legitimacy of a new policy tool in European social policy, the Open Method of Coordination (OMC). It analyses the tensions within the OMC's goals and instruments, develops an explanation of its functioning and applies a multifaceted framework for its evaluation.

The present study addresses the governance architecture of the much debated Open Method of Coordination (OMC) in the field of social inclusion and evaluates its implementation in France, Germany and at EU-level. Based on extensive variable-based empirical research, it assesses both the effectiveness and the legitimacy of the OMC and comes to unequivocal conclusions: Due to the resistance of member states and remaining differences in underlying ideas of social justice, anti-poverty policy could not be Europeanised through the OMC which unfolds as a very weak governance architecture. The general framework of negative integration remains unchallenged by this non-binding instrument which, to the contrary of its intention, rather forecloses the possibility of supranational learning. With regard to legitimacy, the OMC supports policy-making in closed, intransparent circles of very weakly or not democratically mandated representatives and therefore does little do decrease the democratic deficit of the EU - however one of its original ambitions.
