The International Bioethics Committee as a UNESCO working group has for the last several years dedicated to deepen this principle of human vulnerability and personal integrity. La culture est devenue pour chaque société un enjeu économique, social et politique. Toutes les questions liées au pouvoir ont d’ailleurs un lien avec la culture. Et la guerre qui frappa l’ex-Yougoslavie à la fin du siècle dernier en est un exemple éloquent. Elle a cristallisé le mémoricide comme un crime de droit international. Le mémoricide est ce crime contre la mémoire et contre la culture qui pourrait être défini comme la destruction du patrimoine culturel dans l’objectif de reconfigurer une identité collective. À l’échelle politique, l’histoire est en effet un refuge, un réservoir dans lequel les partis politiques puisent des éléments pour étayer leurs propos. Mais peut-on réellement détruire la mémoire ? Comment sanctionner si on ne se souvient de rien ? N’est-il pas dit que « le droit est mémoire et juger c’est d’abord accepter de se souvenir » ?
