As of 1st of June 2023, after years of negotiations, setbacks and postponements, the Unitary Patent Package (UPP) enters into force: the European patent with unitary effect (EPUE) becomes a reality and the Unified Patent Court (UPC) starts its activities. Regrettably, the patent regime put in place is not a genuine EU system. Adopted through an enhanced cooperation procedure, it firstly does not include all EU Member States. Droit d'auteur et marché unique numérique
La complexité des rapports entre le droit d'auteur et le marché unique numérique renouvelle les problématiques classiques de la discipline. Au prisme du droit de communication au public français et égyptien, cet ouvrage interroge la vocation du droit européen à protéger les œuvres littéraires et artistiques de manière efficace. À l'examen du droit positif de l'Union européenne, il n'est pas aisé d'avancer une réponse univoque à cette interrogation. Pour être efficace, le régime européen doit réaliser divers objectifs : harmonisation, sécurité juridique, protection élevée et, surtout, équilibrée. Ainsi, le droit doit prendre en compte un triptyque d'intérêts en concurrence : intérêts des ayants droit, des intermédiaires techniques, et des utilisateurs. Proposant un modèle sous l'angle de ces finalités, l'étude est menée à l'appui de la construction du marché unique numérique.
