Migration and the Crisis of Democracy in Contemporary Europe

This innovative and thought-provoking study puts forth a compelling analysis of the constitutive nexus at the heart of the European refugee conundrum. It maps and historically contextualises some of the distinctive challenges that pervasive ethnic and cultural pluralism present to real politics as on the level of political theorizing. By systematically integrating hitherto insufficiently linked research perspectives in a novel way, it lays open a number of paradoxical constellations and regressive tendencies in contemporary European democracy. It thereby redirects attention to the ways in which liberal thought and liberal democratic institutions shape, interact with, and may even provide justification for illiberal and exclusionary practices. This book thus makes an important contribution to the analysis of post-migrant realities in Europe and the ways in which they are defined by imperial legacies, punitive migration regimes, the culturalization of mainstream politics, and the discursive construction of a European Other.

Constitutional Disintegration and Disruption

  • Categories: Law

The United Kingdom's unprecedented withdrawal from the European Union in 2020 may be regarded as the first example of European 'disintegration'. This moment, however, was preceded by decades of 'disruption' as the UK, Ireland, and Denmark pursued opt-outs from the supranational constitutional order. Constitutional Disintegration and Disruption: Withdrawal and Opt-Outs from the European Union provides the first comprehensive analysis of these two phenomena. The book presents the European Union as an order that is legitimated by individuals playing a dual role as both nationals of Member States and citizens of the European Union; in turn, individuals are both democratic subjects and juridical ...

Populism and Contemporary Democracy in Europe

This book provides a comprehensive analysis of the impact of populism on the European democratic polity. In the last two decades, European democracies have come under strain amid growing populism. By asserting the superiority of the majority over the law, of direct democracy over representation, and claiming the necessity to defend national sovereignty against foreign interferences, the populist conception of democracy is in stark contrast with the longstanding Western notion of liberal democracy. This volume investigates populist attempts to radically change what Bobbio called the “rules of the game” of democracy from an eminently legal perspective. Weaving together normative and empiri...

Secession and European Union Law

  • Categories: Law

Secession is a live issue in today's Western Europe. In the last decade, we have witnessed the consolidation of pro-independence movements in Scotland and Catalonia and in the near future, we might see their re-emergence or the rise of other pro-secession movements in other European regions. The response of the EU institutions to secession within EU Member States may well be based mainly on political considerations. However, since the EU is a community based on the rule of law, it has also to justify its position with normative arguments of principle. Secession and European Union Law provides such normative support, drawing on a pluralist reading of the relation between EU law and national l...

Regionalism is under stress. The European Union has been challenged by the Eurozone crisis, refugee flows, terrorist attacks, Euroscepticism, and Brexit. In Latin America, regional cooperation has been stagnating. Studying Europe and Latin America within a broader comparative perspective, this volume provides an analytical framework to assess stress factors facing regionalism. The contributors explore how economic and financial crises, security challenges, identity questions raised by immigration and refugee flows, the rise of populism, and shifting regional and global power dynamics have had an impact on regionalism; whether the EU crisis has had repercussions for regionalisms in other part...

European Union boundaries have always been unusual. In no other political community is both the prospect of enlargement and the ever-present possibility of withdrawal part of the constitutional framework. We find few other instances where some territories in a political community adopt a common currency while others do not. Examples of thick association agreements, such as we find between the EU and third countries like Switzerland and Norway, are uncommon. Over the last number of years, EU boundaries have been challenged like never before. Brexit poses a fundamental threat to the EU’s territorial integrity and the rights of EU citizens to cross what have been regarded as open borders; the...

Since its inception, the European Union (EU) has revised its foundational treaties several times, resulting in national ratification processes involving different actors, with varying success. This book focuses on the politics of ratification of EU Treaties and reviews the processes of ratification of EU primary legislation. Existing research and academic debate on EU constitutional politics have almost exclusively focussed on negotiation of new treaties and their institutional setting. However, this book explains how the result of ratification was achieved, and analyses the strategy that actors pursue across Europe. Ratification of the Treaty of Maastricht and the EU Constitution failed tot...

This book provides the definitive reference point on all the issues pertaining to dealing with the 'crisis of the rule of law' in the European Union. Both Member State and EU levels are considered. Particular attention is paid to the analysis of the concrete legal bases and instruments that the EU may avail itself of for enforcing rule of law, and the volume clearly demonstrates that a number of legally sound ways of rule of law oversight are available. Contributors are leading scholars who assess the potential role to be played by the various bodies in the context of dealing with the EU's rule of law imperfections
