Le principe de l'Etat social

La Constitution française consacre la « République sociale » tandis que la Constitution hellénique reconnaît « l’État de droit social ». Si le principe de l’État social a été analysé dans les deux États analysés en tant que principe indéterminé au « contenu normatif faible », cette étude l’envisage d’une manière nouvelle. Analysé dans le cadre du normativisme, il convient de ne plus contester la force normative de ce principe mais de déterminer son sens. C’est ainsi qu’on pourra déterminer quel niveau matériel de vie les constituants de ces deux États ont voulu garantir aux individus lorsqu’ils les ont qualifiés de sociaux. Cette question est devenue très actuelle dans le contexte de la crise financière, la France et la Grèce ayant dû réduire leurs dépenses publiques. Toutefois, même en dehors de situations de crise, il s’agit de penser le rôle de l’État et son évolution en matière d’octroi de prestations.
