Parliament

  • Categories: Law

This collection of essays by leading academics, lawyers, parliamentarians and parliamentary officials provides a critical assessment of the UK Parliament's two main constitutional roles-as a legislature and as the preeminent institution for calling government to account. Both functions are undergoing change and facing new challenges. Part 1 (Legislation) includes chapters on Parliament's emerging responsibilities for pre-legislative scrutiny of government Bills and for evaluating proposed legislation against explicit constitutional standards. The impact on legislation of the European Union and the growing influence of the House of Lords are also examined. Part 2 (Accountability) investigates...

Protecting Victims of Human Trafficking From Liability

This books demonstrates the difficulty of protecting victims of human trafficking from being held liable for crimes they were compelled to commit in the course, or as a consequence, of being trafficked, under current European law. The legislation remains vague and potentially inadequate to recognise victimhood, safeguard the human rights of victims, and avoid further victimisation. Muraszkiewicz explains how the non-liability principle is rooted in criminal and human rights law, and proposes a more efficient provision and framework which would protect trafficked persons, and do better to encourage victims to act as witnesses in criminal proceedings against the perpetrators. In doing so the book will provide relevant stakeholders, including policy makers and law enforcement authorities, with a better understanding of the non-liability principle and how it ought to be used in practice.

Exploiting People for Profit

Exploiting People for Profit

This book provides a short, comprehensive, critical analysis of trafficking in human beings. Despite the size and scope of this criminal activity, there remains a need for an accurate, objective, contemporary examination of this threat as the nature of this crime and the strategies developed to counter it are fluid. Trafficking harms not only the lives of those trafficked but equally families and communities, as well as national economies and social cohesion. As this crime spans the spectrum of social science disciplines and fields of study, together with its increasing exposure in the media, this has led to a sharp increase in interest in this topic within the academic community and amongst policy makers, criminal justice practitioners and the wider public. This book draws on current research, the authors’ expert knowledge and insight into current counter-trafficking practices to provide a critical analysis of the crime and strategies to counter its prevalence.

This is a multi-disciplinary work authored by lawyers, political scientists, parliamentary officials, and practitioners and is supported by the Study of Parliament Group (SPG).

This book uses the concepts of vulnerability and resilience to analyze the situation of individuals and institutions in the context of the employment relationship. It is based on the premise that both employer and employee are vulnerable to various social, economic, and political forces, although differently so. It demonstrates how in responding to those complementary institutional relationships of employer and employee the state unequally and inequitably favors employers over employees. Several chapters included in this collection also consider how the state shapes, creates and maintains through law the social identities of employer and employee and how that legal regime operates as the all...
