A nineteenth century sketch of the old abbey of Tralee and Holy Cross Dominican Church in Co Kerry by Rev John C O'Ryan, OP, first published in 1897 and reproduced with introduction and images. The sketch contains the history of the thirteenth century abbey; of the Geraldines, Earls of Desmonds; of the bishops, martyrs and illustrious members associated with the Tralee community including Daniel O'Daly (Father Dominic of the Rosary) and Father Thadeus Moriarty, hanged in Killarney in 1653. It covers the period of the second foundation with notes on David Moriarty, Bishop of Kerry; benefactors of the church; altar plate and a chronology of the abbey 1221-1827.
Enrichment in the Law of Unjust Enrichment and Restitution
Enrichment is key to understanding the law of unjust enrichment and restitution. This book provides a comprehensive analysis of the concept of enrichment and its implications for restitutionary awards. Dr Lodder argues that enrichment may be characterised either factually or legally, and explores the consequences of that distinction. In factual enrichment cases, the measure of enrichment is the objective value received. This is the basis of many awards of money had and received, quantum meruit, quantum valebat and money paid. In legal enrichment cases, the benefit is the acquisition of a specific right or the release of a specific obligation. The remedy is restitution of that right or reinstatement of that obligation. It is demonstrated that specific restitution of the defendant's legal enrichment is often the basis for resulting trusts, rescission, rectification and subrogation. This book has profound implications for understanding restitutionary awards and the relationship between the enrichment inquiry and other aspects of the law of unjust enrichment, including the 'at the expense of' inquiry and the defence of change of position.
Democracy, State Capacity and the Governance of COVID-19 in Asia-Oceania
This book examines the public health responses to the COVID-19 pandemic in the Asia-Oceania region and their implications for democratic backsliding in the period January 2020 to mid-2021. The contributions discuss three key questions: How did political institutions in Asia-Oceania create incentives for effective public health responses to the COVID-19 outbreak? How did state capacities enhance governments’ ability to implement public health responses? How have governance responses affected the democratic quality of political institutions and processes? Together, the analyses reveal the extent to which institutions prompted an effective public health response and highlights that a high-capacity state was not a necessary condition for containing the spread of COVID-19 during the early phase of the pandemic. By combining quantitative and qualitative analyses, the volume also shows that the effect of the COVID-19 pandemic on the quality of democratic institutions has been uneven across Asia-Oceania. Guided by a comprehensive theoretical framework, this will be an invaluable resource for scholars and students of political science, policy studies, public health and Asian studies.
