In rebuilding conflict-affected states, a major portion of foreign aid focuses on reforming public finance management systems and supporting annual budgets. However, how budgets are allocated and how reforms take shape in practice remain critical questions. This book analyzes the politics of reform and budget allocation in the most expensive liberal state-building effort in history: Afghanistan. Through a detailed political economy analysis, it explores the origin, continuity, and evolution of Afghanistan’s centralized public finance management system. Such centralization, readopted in the 2004 Constitution, constrained local participation, perpetuated inequities, and undermined predictabi...
This book explores Nigeria’s progress towards achieving the Sustainable Development Goals, presenting key country-specific lessons, as well as providing innovative solutions and practices which are transferrable to other emerging economies. Despite all of Nigeria’s potential, and substantial oil revenues, poverty remains widespread and the country faces many challenges. This book investigates the relationship between human rights and taxation, exploring how human rights have been impeded or enhanced through tax laws and policies, and what this means for sustainable development in the Global South. Drawing on cases from across the Global South, the book demonstrates the benefits of embedding human rights into tax policies and legislation. The authors not only highlight the role of legislative measures and other human rights regulations in the realisation of international treaty rights but also argue that it creates an environment whereby individuals feel duty-bound to pay taxes, when necessary, thereby securing a sustainable revenue source for the state to meet their socio-economic responsibilities. The book investigates key topics such as compliance, redistribution, e-commerce, tax havens, and the role of key stakeholders. This book will be useful for researchers from across the fields of law, human rights, taxation, and sustainable development.
This paper focuses on the Agreement for the Establishment of the African Continental Free Trade Area (AfCFTA). It argues that commercial activities in precolonial Africa was akin to the phenomenon of lex mercatoria in medieval Europe. It discusses two major tenets embedded in the AfCFTA: the variable geometry principle and the dispute settlement mechanism. It argues that for structural and comparative purposes, these principles (variable geometry and dispute settlement) form the kernel of modern lex mercatoria in the African context. This paper concludes by advocating that the AfCFTA will enhance the principles of lex mercatoria by promoting African trade principles.
